How to Pass the New York Notary Public Exam in 2026

Everything you need to know about the NY DOS examination, official statutory fee schedules, and preparation strategies.

The New York State Notary Public examination is administered by the Department of State (NY DOS) Division of Licensing Services. Unlike many other states that only require a state fee and bond, New York requires all prospective notaries (who are not licensed attorneys or court clerks) to sit for and pass a proctored, closed-book multiple-choice test.

1. Format and Passing Standard

The examination consists of multiple-choice questions covering notary license law and official duties. Examinees are given exactly **60 minutes** to complete the test. Official exam results are reported on a strict **Pass/Fail basis** (no numerical score or percentage is issued). Exam results remain valid for two years from the test date.

2. High-Yield Topics You Must Master

Based on official testing guidelines, the majority of test questions cluster around key statutory domains:

**Executive Law §130-§140:** Appointment requirements, four-year commission terms, county clerk filing procedures, and jurisdiction throughout all 62 counties of New York State.

**Statutory Notarial Fees:** The maximum allowable fee under Executive Law §136 is **$2.00** for administering an oath/affirmation or taking an acknowledgment. Charging more than the statutory fee constitutes official misconduct.

**Jurats vs. Acknowledgments:** A jurat requires the signer to take a formal oath or affirmation and sign in the physical or authorized presence of the notary. An acknowledgment certifies identity and the voluntariness of execution.

**Prohibited Acts & Criminal Penalties:** Notaries who are not admitted to the New York bar cannot give legal advice, prepare wills or deeds, or divide fees with an attorney. Doing so violates Judiciary Law §484 and constitutes a Class A Misdemeanor.

3. Exam Day Strategy

Pace yourself evenly during the 60-minute testing window to ensure all questions are carefully read. Arrive 15 minutes early with government photo ID, a $15 exam fee (card/check/money order; no cash), and two #2 pencils.
